Arbitrage Betamax: l’Etat mauricien sommé de payer 130 millions de dollars à Veekram Bhunjun

La compagnie réclamait Rs 5,2 milliards à l’Etat. C’est le 30 janvier 2015 que le gouvernement Lepep décide de résilier le contrat de Betamax pour le transport de produits pétroliers. Roshi Bhadain, alors ministre de la Bonne gouvernance et des services financiers devait déclarer que : «Après un travail approfondi et après avoir obtenu un avis légal, nous avons découvert qu’il y avait maldonne.»

En avril 2016, le directeur de Betamax porte l’affaire devant la SIAC. L’arbitrage a débuté en août de la même année. Betamax avait signé un contrat de Rs 10 milliards, le 27 novembre 2009, entre elle et la State Trading Corporation (STC). Contrat qui permettait à Betamax d’assurer l’approvisionnement en carburant sur 15 ans grâce à son pétrolier, le MT Red Eagle.

Opposition leader Xavier-Luc Duval is reacting to the news that the Mauritian state was sentenced Tuesday 6 June to pay more than Rs 4.5 billion to Betamax for breach of contract.

"I am horrified by this court order that the government will have to pay more than Rs 4.3 billion in damages to Betamax," he told the Daily Challenge.

Xavier-Luc Duval said he had "begged my former colleagues not to go in this direction, especially after the contrary opinion given by the State Law Office". "The Attorney-General, Ravi Yerrigadoo, Trade Minister Ashit Gungah, former Prime Minister Sir Anerood Jugnauth, as well as the current head of government, Pravind Jugnauth, must all bear responsibility for this decision. But there was some doubt about my good faith about it when I was in government, "he explains.
