Unions stall on signing new pact

The two trade union federations in the Civil Service have expressed concern over the Procedure Agreement which they were supposed to sign with all the ministries.

They have pointed out some discrepancies in the document and demand that regulations of the Public Service Commission regarding disciplinary measures be amended to be in line with the Employment Rights Act and the Employment Relations Act.

The State Employees Federation (SEF) and the Federation of Civil Service and Other Unions (FCSOU) have made their proposals to the Ministry of Civil Service. The Procedure Agreement is a document prepared by the Ministry of Civil Service to standardise procedures between trade unions and various government departments.

According to FSCOU president Toolsiraj Benydin, the Public Service Commission regulations provide for harsher disciplinary measures than those contained in the Employment Rights Act and the Employment Relations Act.

“With the current state of affairs, civil servants have to abide by the Public Service Commission regulations and those of the private sector are concerned with the Employment Relations Act and the Employment Rights Act.

“It is most unfair and we feel that is just that both sets of employees are subject to the same set of laws,” explains Toolsiraj Benydin. Radakrishna Sadien, president of the State Employees Federation, also says that some regulations in the Public Service Commission must be discarded before the Procedure Agreement is applicable.

He adds that another reason why his federation has delayed the entry into force of the Procedure Agreement is that the minister of labour has announced the amendment of the Employment Rights Act and the Employment Relations Act. “It is quite reasonable then for us to wait for the amendments before we sign any document.”
