The textile group Tamak just won the first race in a battle of copyright. Its stores ready-to-wear CITADEL can continue to use the slogan "i ♥ Mauritius". Tamak has succeeded in the Supreme Court against the firm Universal Pentagon, Justice Pritiviraj Feckna having confirmed he owns several trademarks where this slogan and the logo of an "i" feature to its products, some taking the form of the mountain of the thumb.
While Tamak uses the logo with the letter "i" in small letter and capital letter for years, Universal Pentagon has lodged a Supreme Court injunction against it, saying it is the only company to use an "i" on textile products and the slogan "i ♥ Mauritius." So she called for a court order summoning CITADEL to withdraw from the sale of these garments with this logo and slogan in its stores.
Universal Pentagon revealed that Tamak, belonging to the family Tsang Kin Man, trying to take a registered trademark. The judge, however Pritviraj Feckna opposite view. He argues that the logo of an "i" is actually the image of the group: " All trademarks and company names Tamak group include the letter "i". There is no exclusivity about it, " said the judge.
He also rejects the argument of Universal Pentagon to the effect that the slogan used by Tamak is hers: "i ♥ Mauritius is not a trademark. There are nuances on the logos printed on t-shirts sold by Citadel. Even the brand Mauritius is written differently. It's MAURITIUS is a registered trademark of the State of Mauritius. "
The management of Universal Pentagon police had seized last February, arguing that Tamak is reportedly counterfeited products. The police then seized several clothing stores in the Citadel and resellers. The trial will be taken at a later date.
