Gooljaury Tower Ebony: BPML and SICOM Caught Up In
Emergency meeting of the board of SICOM following the bursting of the case of redemption at a cost of Rs 600 million complex of 15 levels still in its infancy, with promoter Rakesh Gooljaury

The Gooljaury Tower, building of 15 levels, which is not even out yet grounding Ebony CyberCity, shakes two state institutions, namely the State Insurance Company of Mauritius (SICOM), principal manager from this year portfolio pensions of officials and other public employees, and the Business Parks of Mauritius Limited (BPML). Since September 4, SICOM is committed to cost Rs 600 million contract with a State Future Sale Completion (VEFA) Rakesh alias with Doomeshwarsing Gooljaury for the purchase of this property, whose end work is scheduled for October 2014. A first payment has already been made in favor of Rakesh Gooljaury by SICOM since the signing of the documents notarized. But with the publication, in its Weekend Edition yesterday after first mention in its edition of 23 December last under this sinister case of real estate transaction, SICOM and BPML are caught in a real turmoil all more than SICOM has not yet digested the recent investment of Rs 340 million in a 14-storey extension to side of its headquarters in Thumb Creek.

In light of recent developments in the margin Gooljaury / Soornack Saga, Karuna Obeegadoo, which provides direction SICOM Group of Companies with a 20-year career in the insurance company prefers to leave it to comment on the record the purchase of the Tower Gooljaury Gilles Hood, Senior Group Manager (Support). The latter questioned by the Mauritian this last investment of Rs 600 million in real estate in the economy, has just confirmed the convening an urgent meeting of the board of SICOM, chaired by Mr Kushal Lobine whose name is mentioned in records of the Registrar of Companies as a business partner Rakesh Gooljaury and Nandanee Soornack.

"At this point, all I can say is that the board will meet in the coming days. After taking note of the information published during the weekend and analysis of the facts, the Board subsequently notify, "said Gilles Chaperon, acting spokesman SICOM, without venturing to comment on information circulating overwhelming on the links between SICOM and Rakesh Gooljaury, the man who was in the bungalow of the Prime Minister, Navin Ramgoolam, at Roches-Noires, at the time of a burglary, which still holds the attention.

The Group Senior Manager (Support) of SICOM would not comment on the state of development of the new 14-storey building along the Thumb Creek, which has been delivered by the contractors of the company PADCO State insurance. "I can not tell you anything. It is better to wait for the deliberations of the board, "he added.

Since September 4, 2012, SICOM is linked with the company Arushi Development Limited Rakesh Gooljaury in a project to build the Tower Gooljaury Ebony is a very strategic location next to the first Cyber Tower. VEFA contract amount of Rs 591,620,860 door on the ground lease an area of 8096 square meters with a building under construction 15 levels, 13 floors 1 044.1 square meter each in addition to a ground floor and a mezzanine.

Shadows

At the end of the agreement signed between the two parties, the work on the project should start in November last year to be completed in November 2014, twenty-four months instead of eighteen months as originally discussed. A first payment of the amount approved has already been done by the SICOM to Rakesh Gooljaury before the start of work on the site Ebony last September.

One of the main shadows in the discharge of SICOM is the decision to purchase the project on paper Gooljaury Ebony Tower while the insurance company has the financial and technical resources required to undertake such an initiative in the field property. Another intriguing fact is the almost simultaneous delivery of a new building SICOM brand new 14-storey, built almost half the agreed price for Gooljaury Tower. Those attending the Capital Region go very well aware that the development of this Annex HQ SICOM has not even started yet so far.

Dealings between SICOM and Rakesh Gooljaury for the realization of off-plan contract of Rs 600 million, almost four times the Price Tag MedPoint dates back to 2010. The first element is confirming this fact in a letter from the Business Parks of Mauritius Limited (BPML) dated 13 January 2011 addressed to the company Arushi Development Ltd, deadlock Ibis Sodnac, Quatre-Bornes, on the lease of Lot 46 C to Ebony.

"We Refer to your letter dated 12 January 2011 and wish to inform you That We Have No objection to you Assigning the lease in Favour of SICOM Ltd. Provided the use is for offices, ICT, and other related activities as well as for commercial purpose , "wrote K. Gujadur on behalf of the Executive Chairman of BPML about the request to transfer the lease of the land on the Arushi Development Ltd. SICOM.

But already the details of this letter on the lease are in clear contradiction with the terms of the lease agreement between the BMPL Arushi and Development Limited 19 March 2009 for the lot at 46 C Ebony. The letter of 13 January 2011 contains new conditions more favorable when the lease was solely and exclusively to developments in the ICT sector.

"... As well as business purpose"

Paragraphs 2.1 and 2.2 of Land devoted to Lease are categorical: "BPML hereby grants to the lessee a right on the land for the lease period to set up year for ICT Business Office and other related operations as set out in the proposal of the lessee . No change of use permitted Shall be except with written approval and on terms and conditions Such new as set by the lessor. The lessee furthermore Shall not carry out illegal or prohibited activities Any Within the leased property. "

The question that arises is the author of the instructions to include the phrase "as well as business purpose" - a move interpreted as a favor and change the terms of the lease - in a letter dated 13 January 2011 issued by BPML. In this last state-owned company, involved in the transactions SICOM / Gooljaury none of the sources has approached declined to comment on what has become a "Very Hot Political Issue" or confirm the information in the effect that the batch 46 C Ebene Cyber City was identified and reserved as a Space Green beside the first Cyber Tower.

On the other hand, when the lease document dated 19 March 2009 fixed the commencement of work on site within six months, the first sod for the construction of the Tower Gooljaury was given over 44 months after no response from BPML. The lease on the land granted to Arushi Development Limited and sold to SICOM covers 30 years with an initial payment of Rs 10 million annual rent of Rs 600,000.

Jugnauth: "I asked SICOM to stop this transaction"

The acquisition of Tower Gooljaury by SICOM cost of Rs 600 million leads to a first standoff between the former Deputy Prime Minister and Finance Minister Jugnauth, and former Senior Adviser, Sunil Dowarkasing today Senior Adviser in government Ramgoolam. Sunil Dowarkasing stated publicly that former finance minister was aware of the negotiations between Rakesh Gooljaury, the strong man of Navin Ramgoolam, and SICOM.

Jugnauth does not deny his former Senior Adviser but contends that the Finance Ministry had commissioned the same Sunil Dowarkasing to convey his objection to the project board of the insurance company State.

"I remember when I learned these discussions, I asked SICOM to stop this transaction. You should know that all this was done in secret even though I was the Minister of Finance. I even called the Gooljaury called to say that such a case can not be tolerated, I simply replied ine Boss gives fire worm. Pe new German forward. Ine say ki mo li enn betiz zotte eg iron, "said the Mauritian Jugnauth.

"I must also add that Sunil Dowarkasing, which is now in the government, was mandated to transmit the objection of the Ministry of Finance in SICOM on this transaction," said the leader of the MSM.
