Judge Nirmala Devat has issued an interim order against Goorooduth Mithoo and Iswar Mithoo.
The Mithoos now have to stop all construction and excavation work on the plot of land located next to Sir Gaetan Duval’s bungalow at Sir Gaetan Duval Road, Melville, in Grand Gaube.
The injunction will be maintained till June 6 when both Mithoos will be called to appear before the judge to explain why the order should not be “interlocutory, enlarged, discharged or otherwise dealt with”.
The board committee of the north is represented by A Jankee. The Mithoos will now have to repair the damage caused during the excavation work.
This is after minister for Social Integration Xavier-Luc Duval contested the work undertaken by his neighbours near the bungalow of late Sir Gaetan Duval.
The minister said that the excavation of sand carried out by a JCB machine was a direct threat to the residence of the Duvals as this could eventually cause a landslide.
Following the complaint lodged by Duval, the authorities concerned visited the site and warned the Mithoos for “unlawful removal of sand”.
The board committee of the north said that permission was not given for excavation of sand at this depth.
